Term and conditions of sale
​​ Any order for a product appearing on the www.monarchmtb.com online store requires prior consultation of these terms. Consequently, the consumer fully accepts that their agreement on the content of these conditions does not require the signature of this document, insofar as the customer wishes to order the products presented online in the framework of the website. The consumer has the option to save or print these general conditions, with the saving and printing of this document being the sole responsibility of the consumer. The consumer declares that they have full legal capacity to accept the present general terms & conditions of sale. MONARCH MTB reserves the right to modify the present general terms & conditions of sale. Article 1 - Integrality The present terms represent all obligations of the parties. This contract is concluded between a consumer and MONARCH MTB in the case of a system of selling goods at a distance. In this sense, the consumer is deemed to accept without reservation all the provisions of these terms. No general or specific condition appearing in documents sent or given by the consumer may be incorporated herein, since these documents are inconsistent with these terms. Article 2 - Object The present general conditions are intended to define the rights and obligations of the parties as part of the online sale of goods offered by MONARCH MTB to consumers. The consumer declares, prior to their order, that the acquisition of these products is not directly related to their professional activity, their acquisition being reserved for personal use. As a consumer, the customer has specific rights, which would be jeopardized in the event that the goods or services purchased through the website were in reality related to their professional activity. Article 3 - Contractual documents This contract consists of the following contractual documents, presented in descending order: - the present general conditions - the pricing structure for shipping of goods - the order form In case of conflict between the provisions contained in the documents of different ranks, the provisions of the document of higher rank will prevail. Article 4 - Validity and duration These conditions come into force on the date of confirmation of the order. These general conditions are concluded for the time necessary for the provision of goods purchased, until the expiry of the guarantees legally owed by the seller. Article 5 - Order confirmation All contractual information will be confirmed via e-mail no later than the time of delivery or failing that, to the address specified by the consumer in the purchase order. Article 6 - Proof of transaction The records stored in MONARCH MTB's computer systems under conditions of reasonable safety, will be considered proof of communication, orders and payments between the two parties. The filing of purchase orders and invoices is done on a reliable and durable media which can be produced as evidence. MONARCH MTB can in no way be held liable for any loss of data following an incident in which they are not responsible. Article 7 - Product information Article 7.1: MONARCH MTB displays products for sale on their website with the necessary characteristics to allow the potential consumer to discover, before ordering, any essential information on a particular product required before buying. The descriptions, characteristics and illustrations of our products are produced with the greatest of care. Errors can appear however, as well as modifications carried out by MONARCH MTB. We therefore take no responsibility for such disparities, nor can the validity of the transaction be called into question. Article 7.2: The present online offers are valid while stocks last. If the article is not in stock, the order will not be possible, with the consumer being alerted to any error as quickly as possible. Article 8 - Pricing All pricing is in Australian dollars. Pricing does not include transport costs which are added to the final invoice, and are indicated before final confirmation of the order at checkout. Pricing takes into account the taxes applicable on the day of the order, with any rate change being automatically applied to the price of the products online. Payment of the totality of the order must be completed during the order process. At no point can any amount submitted be considered as a deposit. In the case of an export sale, all applicable taxes in the buyers country remain the responsibility of the buyer. MONARCH MTB reserves the right to modify pricing at their discretion. Any pricing modifications will be signaled to the buyer before any order throughout the year depending on exchange rates and the increase in price of raw materials. Article 9 - Method of payment MONARCH MTB accepts payment by credit card. Your order will only be confirmed once payment has been received by MONARCH MTB. Article 10 - Product availability In the case of product unavailability, particularly dependent on our suppliers, the consumer will be informed as quickly as possible and will have the possibility to cancel their order or to transform it. In the event of an order cancelation, we hereby commit to reimburse the consumer or issue an exchange voucher as quickly as possible. Article 11 - Order processing All products sold by MONARCH MTB are hand picked to order. Order processing will vary depending on the product: - Bikes are hand assembled when orders are received and processing time 3-5 days - Parts and components orders will be processed with 2 business days Article 12 - Delivery procedure Products are delivered throughout Australia to the address indicated by the consumer on the order form. Any delivery anomaly (missing parcel, missing product as listed on the order form, damaged parcel, broken products, etc) should be indicated on the delivery form, accompanied by the customers signature. The consumer will need to confirm this anomaly by addressing the reclamations in a letter to the delivery company within two (2) days via recorded delivery letter with counter-signature. The consumer will need to transmit a copy of the annotated delivery note via mail to MONARCH MTB. The consumer is responsible for verifying the condition of the parcel(s) and the number of parcels delivered in the presence of the delivery driver. In case of doubt, the consumer should refuse the delivery and inform MONARCH MTB. All our expeditions are covered by insurance corresponding to the value of the parcel and is taken care of by our company. Article 13 - Delivery times Delivery times are generally between 1 and 7 days in Australia. Please note that the delivery time indicated is a guide only and can vary. Any eventual delays will not result in compensation, withholding of payment or cancellation of the order by the purchaser. Article 14 - Delivery errors The consumer must signal any claim to MONARCH MTB on the day of delivery or at the latest the first day of business after delivery, any claim of error of delivery and/or non-conformity of goods in kind or in quality as specified on the order form. Any claim made after this time will be rejected. All claims should be made via : hello@monarchmtb.com Article 15 - Delivery costs The shipping costs will be indicated, and added to the total on each order as done by the buyer. The amount of postage will be adjusted depending on the destination of the order. Article 16 - Product guarantee All MONARCH MTB bicycles and components, sold on the present online store, are subject to the general warranty conditions available below. ​ Article 17 - Data protection act Information collected is necessary for the processing of your order and of the expedition of any future correspondence by MONARCH MTB. If you no longer wish to receive any commercial offers, all you need to do is unsubscribe yourself from the newsletter or send an email to hello@monarchmtb.com Article 18 - Partial non confirmation If one or more provisions of these terms are held to be invalid or declared as such under any law, regulation or after a final decision of a competent jurisdiction, the remaining provisions will remain in full force and scope. Article 19 - Non-waiver The failure of either party not to claim a breach by the other party to any of the obligations under these Terms shall be construed in the future as a waiver of the requirement involved. Article 20 - Applicable laws The present general terms & conditions are under the jurisdiction of the state of Australia. In the event of a dispute, the consumer should first and foremost contact MONARCH MTB. so as to find an amicable solution. ​
Returns and refunds policy
​​ Article 1 - Cancellation of order ​ If the customer wishes to cancel an order: - within 24 hours* a refund will be issued minus a 3% transaction fee. - after 24 hours* but before product is shipped, a 5% transaction and handling charge will be retained. - after 24 hours* and the product has already been shipped, a 5% charge will be retained and the customer will be responsible for the cost of return shipment. - All cancellation requests to be emailed to info@monarchmtb.com * references time from placement of order to receiving written request from customer. ​ Article 2 - Returns Returns will be granted conditional to the below: - Customer to request return within 24 hours of receiving product - Products to be unopened as received condition. - Customer to pay for return freight costs. - A 5% restocking fee will be retained. - All returns requests to be emailed to info@monarchmtb.com Article 3 - Refunds - Refunds will be made to original purchaser only. - Refund time frames:      - Products that have not yet shipped:            - 3 business days from acknowledgement of request.      - Products that may shipped:           - 3 business days from receipt of returned products. ​
General warraty
​​Duration From 1st January 2024, MONARCH MTB undertakes to guarantee its products in the case of manufacturing or material defects for the following time periods: - All bike frames for five years (5 years), - For full-suspension bikes, the chain stays are guaranteed for two years (2 years), - Forks, Carbon and suspension are guaranteed for two years (2 years), - Components are guaranteed for two years (2 years) ​ The life of a product will vary according to its construction and the materials used. The following factors will also affect its life span - frequency of use, aggressiveness of riding, the level of maintenance performed etc. The guarantee is not an all-risk insurance and therefore it does not apply: - If damage was caused during the transport of the bike between our warehouse and your home (the damage must be reported to the carrier in writing), - If damage is caused by normal wear including fatigue of materials over time, - If the bike is misused beyond the framework of correct usage, - If there has been inadequate maintenance or negligence on the part of the owner, - If parts are worn, such as derailleur hangers for example, - The frame has deformed, a sign of an excessive load, - In the event of an accident (fall, collision etc.), - If the bike has been continually used whilst it was already damaged, - If the bike has suffered damage resulting from an intentional fault or the liability of a third party, - In the event of impacts suffered from external elements (natural disaster, fire, humidity etc.), - If used in non-compliance with safety standards, - In the case of modification to the product (painting or polishing of the frame), - In the case of modification made to any components on the bike which result in a change to its geometry or function (maximum height of fork not respected, change in dimensions of the shock etc.). Conditions for application or the warranty During the warranty period we undertake to replace, at our expense and at our discretion, frames and parts that are defective in workmanship or materials. The defect must be validated by our customer service team. They will be solely responsible for the decision regarding the implementation of a guarantee. The warranty is only applicable - To bikes and components purchased from one of our website, - To the first owner. The guarantee is not transferred to the following buyers after resale, - Strictly in the case of normal use. ​ Maximum rider weight Fully equipped: - Children’s bikes:        12’’ - 16’’ = 28kg        20’’ - 24’’ = 43kg - Junior bike = 63kg. Normal wear and tear Normal wear and tear is defined as damage that occurs naturally and inevitably as a result of the normal use of a bike. For example, your cassette and chain will wear out eventually, even if they are properly maintained they will need to be replaced one day. The same goes for scratches and other potential damage to a bike’s paint or graphics that can result from normal use and exposure to the elements. Over time, your bike may also develop creaking or other noises during use, which usually means it needs some maintenance. Items subject to normal wear and tear are not covered by this warranty. Below is a non-exhaustive list of products that are subject to normal wear and tear and therefore not covered by the warranty: - Frame bearings (covered by a six month warranty) - Freehub body (covered by a six month warranty) - Paint and graphics - Brake pads - Handlebar grips - Brake housing and cables, derailleur, seat post - Spokes/spoke nipples - Worn axles/threads - Tyres - Brake discs - Grips - Fork seals If you have the slightest doubt with regards to a specific part, please contact our customer service department. We will be happy to find the best solution to your problem. Limitations of responsibility This warranty is restrictively defined here as the complete and final warranty of MONARCH MTB frames and components. As a result, no retailer or other third party is authorised to expressly or implicitly assume or grant any extension of the warranty or additional warranty to that defined in these warranty conditions. MONARCH MTB will not be liable for any amount exceeding the actual purchase price of the bike or for any special, incidental or consequential damages arising in connection with said bike. This limitation is established within the strict limits of the law applicable to the contract and commercial habits established by the use. Recommendations Cycling, whether on a road, path, track, on snow, in the city, or a forest, in a bike park, uphill, downhill, with 12/14/16/20/24/26/27.5/29-inch or 700c wheels, alone, in pairs or in a club, is a risky sport. We therefore recommend that you first choose the appropriate equipment for your practice by consulting our customer service team. Also, be aware that within your budget, you must take into account the purchasing of a number of essential safety items. The most important is obviously a helmet whatever the practice. Other protection is available and essential for certain practices. For example; gloves, back protection, knee pads, elbow pads etc. The equipment evolves quickly and allows you to push your limits. Monarch MTB uses a SSL secured payment gateway from Eway to ensure that your credit card details are safe. Monarch MTB staff do not see any card details which you have directly entered into our site. ​ How we use cookies ​ A cookie is a small file which asks permission to be placed on your computer's hard drive.
